Here's what I'm not conflicted about: When authorities can't get what they want by working within the law, the right answer is not to work outside the law. The right answer is that they can't get what they want. The Unites States is — or should be — subject to the rule of law, which makes the extra-judicial pursuit of WikiLeaks especially nauseating. (Calls for Julian's assassination are even more nauseating.) It may be that what Julian has done is a crime. (I know him casually, but not well enough to vouch for his motivations, nor am I a lawyer.) In that case, the right answer is to bring the case to a trial. IIn the US, however, the government has a "heavy burden" for engaging in prior restraint of even secret documents, an established principle since New York Times Co. vs. The United States * , when the Times published the Pentagon Papers. If we want a different answer for WikiLeaks, we need a different legal framework first. [...] The key, though, is that democracies have a process for creating such restrictions, and as a citizen it sickens me to see the US trying to take shortcuts. The Iraqi concerns, analysed in a dispatch sent from the US embassy in Baghdad by then ambassador Christopher Hill in September 2009, represent a fundamental divergence from the American and British view of Iran as arch-predator in Iraq. "Iraq views relations with Saudi Arabia as among its most challenging given Riyadh's money, deeply ingrained anti-Shia attitudes and [Saudi] suspicions that a Shia-led Iraq will inevitably further Iranian regional influence," Hill writes. "Iraqi contacts assess that the Saudi goal (and that of most other Sunni Arab states, to varying degrees) is to enhance Sunni influence, dilute Shia dominance and promote the formation of a weak and fractured Iraqi government." Hill's unexpected assessment flies in the face of the conventional wisdom that Iranian activities, overt and covert, are the biggest obstacle to Iraq's development. It feeds claims, prevalent after the 9/11 attacks, that religiously conservative, politically repressive Saudi Arabia, where most of the 9/11 terrorists came from, is the true enemy of the west. Hill's analysis has sharp contemporary relevance as rival Shia and Sunni political blocs, backed by Iran and the Saudis respectively, continue to squabble over the formation of a new government in Baghdad ... | | | | | | | | | | | | | | | | | | | | | Source: www.dailymail.co.uk --- Monday, December 06, 2010 The whistleblower has been accused of sex crimes, but the prosecution's case has several puzzling flaws and the affair has been branded a 'honeytrap' ... | | | | | | | | | | | | | | | | | | | | | Source: www.switched.com --- Monday, December 06, 2010 Here are a few of the other noteworthy things we saw today on our never-ending journey through the wild, wild Web. Politicians would end the war in Afghanistan immediately if there were no reason for us to stay. We risk the lives of servicemen, we spend billions of dollars on equipment, food, pay and other expenses, and the war itself is unpopular in many sections of society. All three are of themselves decisive reasons to end the war, and if it were just that deciding the matter, no politician would hesitate to pull back. But there is much more to it than that. We have strong and compelling reasons to stay in Afghanistan. Firstly, it is in our interests to pursue and hound terrorists and their supporters wherever they may live, and not give them a safe haven on the border between Pakistan and Afghanistan. Secondly, by stabilising the region through suppressing Taliban activity, we increase our own national security. Thirdly, our presence is spreading liberal democracy and fundamental freedoms to the people of Afghanistan – inherently good things. Fourthly, to leave now would be to waste the lives of those who have died in Afghanistan and the billions of pounds we have spent in aim of our objectives. The ignorance of many on the war in Afghanistan is stupendous. You would have thought that these people would have been more informed, considering that they have spent the last 10 years listening, seeing and reading about this war. The cable released by WikiLeaks has revealed that Mr Rudd, when prime minister, warned Ms Clinton to be prepared to use force against China "if everything goes wrong". Mr Rudd also told Ms Clinton during a meeting in Washington on March 24 last year that China was "paranoid" about Taiwan and Tibet and that his ambitious plan for an Asia-Pacific community was intended to blunt Chinese influence. "I don't believe that that's an appropriate piece of advice for Mr Rudd to give the United States," opposition foreign affairs spokeswoman Julie Bishop told ABC Radio. "I call on Julia Gillard to detail whether this remains the view of the Labor government." Mr Rudd and the prime minister have declined to comment on the cable. But Labor backbencher Doug Cameron defended Mr Rudd. "Diplomacy is a tough game and international relationships is an extremely complex situation for governments to deal with, especially when it comes to the rise of China," Senator Cameron told Sky News. This weekend's opening sketch featured cast member Bill Hader as Australian Assange, introducing his latest scandal-sleuthing project, "WikiLeaks: TMZ." "Hello, America, I'm Julian Assange, founder of WikiLeaks, and I've taken over your airwaves," announces Assange as he interrupts a speech by President Obama (Fred Armisen). "This week, my organization released thousands of classified cables, revealing embarrassing details about the international diplomatic community. The leaks did not inspire revolution as I had hoped so tonight I present a new WikiLeaks, where the leaks are even more embarrassing and the details are even more sordid." That project is "WikiLeaks: TMZ." Assange is then seen in a newsroom a la "TMZ" host Harvey Levin with his team informing him of the latest scandals they've captured on camera. Among the gems: Muammar Gaddafi (Armisen) leaving a Libyan restaurant with his sexy Ukranian nurse (Kristen Wiig), who reveals that she's also a prostitute; Afghanistan president Hamid Karzai claiming he doesn't take bribes as his briefcase splits open and cash spills out; and Hillary Clinton (Vanessa Bayer) exiting a car in a skirt, which reveals that she's not wearing underwear. All the while, its founder is being sought by law-enforcement authorities stemming from charges in Sweden. Assange's lawyer, Mark Stephens, was negotiating with British police Monday to discuss the Swedish arrest warrant, The Associated Press reported. Over the weekend, the site began losing access to funding. On Friday, e-commerce service PayPal closed WikiLeaks' account . PayPal, like Amazon before it, said WikiLeaks violated its terms of service: PayPal has permanently restricted the account used by WikiLeaks due to a violation of the PayPal Acceptable Use Policy, which states that our payment service cannot be used for any activities that encourage, promote, facilitate or instruct others to engage in illegal activity. Only a few documents have been revealed so far, none related to Estonia, but diplomats are already taking measures for damage control, as the US Ambassador to Estonia revealed an article titled "Estonia and the US: Rock-Solid Allies" in the opinion section of the country's largest daily newspaper Postimees today. Minister of Foreign Affairs Urmas Paet said he does not know the substance of the clandestine documents pertaining to Estonia that WikiLeaks plans to reveal. Paet said he was warned by the US Embassy ahead of time. "Last week, US Embassy representatives in Tallinn turned to the Ministry of Foreign Affairs and informed us that such a leak is coming," he told ETV. Eerik-Niiles Kross - a former high-level security analyst who advised the Georgian government - believes the WikiLeaks revelations could endanger US relations with its allies. Lebanese Telecommunications Minister Marwan Hamadeh decried the establishment of the separate communications network, calling it "a strategic victory for Iran." Hamdeh said that setting up the fiber optics network was "the final step in creating a nation-state, and that "Hizbullah now has an army and weapons; a television station; an education system; hospitals; a financial system; and a telecommunications system." Discussing the options of the Lebanese government in countering the independent communications network, Hamadeh said that the Hariri government had two choices: to seek a UN Security Council resolution, or to cut the fiber optic lines. However, the telecommunications minister said he was told by a Hizbullah official that "any move against the FiOS [fiber optics system] would be taken as 'an Israeli attack' and dealt with accordingly." However this interview in the Guardian gives perspective on Assange and WikiLeaks. I can't believe I need to say this, but we need to look with tweezers at the Swedish law Assange is alleged to have violated. James D. Catlin, the Melbourne barrister who represented Assange in London, wrote Apparently having consensual sex in Sweden without a condom is punishable by a term of imprisonment of a minimum of two years for rape….Now, three months on and three prosecutors later, the Swedes seem to be clear on their basis to proceed. Consensual sex that started out with a condom ended up without one, ergo, the sex was not consensual. Consensual sex without a condom is rape? Well, in Sweden, if there's no condom, it is. I spent ten–celibate, in case you were wondering–days in Sweden this summer and wonder how many bands and attendees at the rock festivals knew this "condom or it's rape" law. I hope it's info that gets added to their tourism packets. I guess now all Swedish citizens are aware of this quirk as well. I'm all for using condoms until everyone is tested and trusted, but this is a Swedish law is intrusive, repressive and downgrades rape–forced sexual intercourse ... | | | | | | | | | | | | | | | | | | | | | Source: www.someecards.com --- Monday, December 06, 2010 ... | | | | | | | | | | | | | | | | | | | | | Source: www.theatlanticwire.com --- Monday, December 06, 2010 Saturday Night Live's spoof of WikiLeaks and Julian Assange, the group's founder, is funny. But it's also got some ideas of which Assange may want to take note. The SNL skit portrays WikiLeaks as abandoning its media strategy, which the fake Assange says failed "to inspire revolution, as I had hoped," and adopting an approach better designed to capture peoples' attention. Specifically, SNL has WikiLeaks mimmick the muckraking celebrity gossip website TMZ. After all, lengthy State Department cables explaining geopolitical complexities are not very engaging for most people. But everyone loves celebrity gossip. So why not use the TMZ approach to expose diplomatic misdeeds? The list was the result of a February 2009 order from Washington for officials to compile a list of international assets critical for the United States… The list of "critical infrastructure and key resources located abroad" detailed hundreds of pipelines, important data cables, and businesses belonging to international industrial and pharmaceutical giants. If destroyed, these sites could damage US interests, the diplomatic communique said. Although some of these overseas sites were already known to terrorists, many others undoubtedly were not. Thanks to WikiLeaks, Osama bin Laden and his ilk now have more targets to choose from – and not just any targets, but ones the U.S. considers vital to global security. There is an upside to WikiLeaks' latest attack against the U.S., however; Julian Assange and his minions can no longer pretend they're publishing these cables because they believe in 'transparency' or whatever other excuse they use when they're criticized. Publishing this particular cable makes no sense whatsoever; there is no rational reason to put this cable on the Internet for everybody to read ... | | | | | | | | | | | | | | | | | | | | | Source: whaleoil.gotcha.co.nz --- Monday, December 06, 2010 Citizen A — 8pm Sunday Sky 89 & Freeview 21 Tune in to join Bomber and his revolving panel of bloggers and Auckland opinion shapers as they offer an up-to-date half hour review of the political media issues of the current week from a very Auckland perspective.
