Naidu continues fast in hospital, condition turns alarming - The Hindu

Sivakumar A determined Telugu Desam president N. Chandrababu Naidu continued his fast for the fourth day on Monday at the Nizam’s Institute of Medical Sciences (NIMS), even as his condition turned alarming.

Earlier, he was forcibly shifted there from the hunger strike camp by the police in the wee hours amidst high drama. Not satisfied with the relief package announced by the Government for flood-hit farmers, he began his fast on December 17 demanding a fair deal to them.

Following deterioration in his condition last evening, the authorities began preparations to arrest and shift him to hospital. After getting wind of the impending arrest, scores of TDP supporters reached the venue to resist any police action. Amidst stiff resistance from MLAs and other supporters, including several women, police swooped down the on the camp and arrested Mr. Naidu.

Several TDP leaders surrounded Mr. Naidu on the dais in a bid to prevent the police from arresting him, while scores of others who gathered at the site. Some of them hurled chairs at the police. As the TDP activists threw a cordon around Mr. Naidu, the police pulled out each of them and carried him into a waiting vehicle. In the melee, N. Lokesh Naidu, son of Mr.Chandrababu Naidu, and others suffered mild bruises.

A defiant Mr. Naidu told the police officials that his condition was alright even as other senior TDP leaders questioned the right of the police to arrest him from new MLA quarters.

Protesting against his arrest, the Telugu Desam has called for a State bandh today, which was supported by CPI(M) and CPI parties. There were widespread protests by TDP activists all over the State and RTC buses were damaged at several places

Meanwhile, Health Minister D.L. Ravindra Reddy said the TDP leader’s condition was alarming and appealed to him to call off the fast. Rashtriya Lok Dal president, Ajit Singh and Panthers Party leader, Bhim Singh were among those who called on Mr. Naidu at the hospital.

Condemning the arrest, Telugu Desam leader K. Yerran Naidu the attempt to foil Mr.Naidu’s fast was a conspiracy by Central and State Governments in view of the "unimaginable response" from farmers and the people.

Spectrum scam: Pranab rules out JPC - The Hindu

Finance Minister Pranab Mukherjee on Saturday ruled out a JPC probe into the 2G spectrum scam. Rajeev Bhatt Ruling out a Joint Parliamentary Committee (JPC) probe into the 2G spectrum scam, Finance Minister Pranab Mukherjee on Saturday appealed to the opposition parties to let Parliament function so that a debate on the issue could take place.

“I have requested them (opposition) to come back to the House and let the whole issue be debated in Parliament.

Let them say whatever they want to say on the floor of the house and the government will respond,” he told reporters here.

“As soon as the CAG (on the 2G spectrum) report came, the matter was referred to PAC. It is a permanent JPC having members from both Lok Sabha and Rajya Sabha. Therefore, PAC itself is the JPC. I don’t understand why the JPC should be there,” he said.

Mr. Mukherjee said it is the constitutional responsibility of the PAC to examine the report of the CAG.

He said side by side all relevant inquiries were going on.

On the government’s effort to end the stalemate in Parliament, Mr. Mukherjee, the leader of the Lok Sabha, said the Speaker had called a meeting of all parties and there were several formal and informal discussions.

Centre seeks Rs. 5,786 crore for Bhopal gas victims

New Delhi: Coinciding with the anniversary of the 1984 Bhopal gas tragedy, the Centre on Friday filed a curative petition seeking enhancement of the compensation of $ 470 million determined by the Supreme Court in 1989 on the ground that this settlement was arrived at on the basis of assumptions of truth unrelated to realities.

The Centre as parens patriae (parent of the nation) of the victims of the world's largest industrial disaster already filed a curative petition for restoration of the stringent charge of culpable homicide not amounting to murder, which attracts the maximum punishment of 10-year jail term, against the accused.

The petition, drawn by advocate Devadatt Kamat and settled by Attorney-General G.E. Vahanvati, has cited as respondents the Union Carbide Corporation, now a wholly owned subsidiary of Dow Chemicals Co., U.S.; Dow Chemicals ; McLeod Russel India, Kolkata, and Eveready Industries, Kolkata.

The present petition sought a review of the May 4, 1989 and October 3, 1991 orders, contending that the 1989 settlement was seriously impaired. An additional compensation of Rs. 675.96 crore under various categories had become due and payable in 1989. “Since the said amount is being claimed in 2010, several aspects such as devaluation of the rupee, interest rate, purchasing power parity and the inflation index have to be factored in while computing the claim amount.” So the total would come to Rs. 5,786 crore.

In addition, Rs. 1743.15 crore for relief and rehabilitation, which Madhya Pradesh undertook due to the tort on the part of the Union Carbide India Limited and the Union Carbide Corporation and other respondents, had to be reimbursed on the ‘polluter pays' principle. The petition also claimed Rs. 315.7 crore towards measures for remedying environmental degradation caused by the respondents.

The Centre said that after the trial court in Bhopal pronounced its verdict in the criminal case against the accused on June 7 awarding two-year imprisonment there was widespread public outcry and concern throughout the country. This led to a comprehensive reconsideration and review at the highest level by the Union of India of all issues of the gas tragedy and its aftermath.

On compensation, a thorough review of all issues was conducted. Various extremely hazardous wastes were lying on and around the factory premises. But the impugned judgments and orders “do not take into account the impact of the disaster on the environment” and as “the respondents are liable to pay the costs on account of environmental degradation it is imperative that the settlement figure be reworked keeping in mind the true ground realities i.e. the actual number of fatalities and injuries.”

The petition said “the total number of death cases resulting from the tragedy is 5,295, whereas the impugned order proceeds on the basis that there were only about 3,000 deaths. Similarly, the number of cases of minor injuries is 5,27,894, whereas the impugned order proceeded on the basis that there were only 50,000 such cases. ”

The Centre said: “The RBI has reckoned that if the amount was invested at monthly, half yearly or yearly LIBOR, then the investment at yearly LIBOR would yield the highest return. Accordingly, the amount of additional compensation to be claimed should be $ 1241.38 million or Rs. 5,786.07 crore at present value.” and sought a direction in this regard.

The CBI registered the case under various sections of the Information Technology Act and said efforts were underway to restore the website for public interface at the earliest, an official spokesperson said here.

In a brief statement, the spokesperson said, “It has come to the notice of the CBI that its official website was illegally accessed and defaced in the intervening night of December 3 and 4.

“A case has been registered in this connection in the cyber crime cell of the CBI and efforts are underway to restore the website with the help of National Informatics Centre and the CBI cyber security experts,” the spokesperson said.

The home page of the CBI website was hacked and it had a message from the ‘Pakistani Cyber Army’ warning the ‘Indian Cyber Army’ that their websites should not be attacked.

The message from the hackers also spoke about the filtering controls provided by the NIC, a body which mans computer servers across the country.

Intelligence agencies have been warning the government that proper cyber security was not being ensured in offices and that no security audit was being carried out.

The ‘Pakistani Cyber Army’ also threatened to carry out “mass defacement” of other websites.
